By completing the signup form you acknowledge that you have read the terms of service below for the LeatherGiftItems.com Affiliate Program (owned and operated by Gift Items Etc.), and that you understand and agree with them. We do not accept spam sites and will conduct in-depth research on our Affiliate Partner applicants.

Below are terms of service defining the relationship between Gift Items Etc. and our affiliates, and defining the role, rules, and obligations asked of our affiliates.

1. As a United States-based affiliate, you are an independent contractor and not an employee of Gift Items Etc. This program is limited to U.S.-based Affiliates.

2. Taxes and other outside fees associated with your own income production are your responsibility and you must provide us a W-9 form (the W-9 form can be found along with instructions on The Affiliate "Join Now" page).

3. All online Affiliate marketing efforts must comply with all spam and "truth in advertising" laws. Furthermore, all online marketing must be associated only with legal and professional items, services, and activities.

4. Offline Affiliate marketing must also comply with all applicable marketing and business laws. As was with # 3 above, all offline marketing must be associated only with legal and professional items, services, and activities.

5. Any online or offline programs initiated by you are your financial responsibility. In other words, if you create/purchase an advertisement to direct people to your site and link, it is up to you to pay for that ad.

6. All Gift Items Etc. site templates, sample pages, email templates, and product components are copyrighted and/or proprietary and any use thereof must be intended for a sale that finalizes through Gift Items etc./LeatherGiftItems.com site. In other words, The Affiliate cannot use our marketing materials or products to generate sales for other products, people, or companies.

7. You agree not to misrepresent the product to any potential customer or potential sub-affiliate.

8. You agree not to misrepresent the earnings potential of this product to anyone, especially sub-affiliates you may recruit. At some point in our relationship we may extend a second tier to this program which would entitle you to receive earnings on sub-affiliates who promote and/or sell our products.

Our Earnings Statement:

We make no claim as to the amount of money you or your sub-affiliates will earn, above and beyond our set amount of commission. All sales credited to you will be the result of your own efforts and/or the efforts of groups of fellow marketers or sub-affiliates, or your recruit. All people or groups recruited by The Affiliate, and/or working for The Affiliate, must adhere to our "Terms of Service."

Our Payout Percentage and Conditions:

9. Our commission pay outs are based on sales that finalize on our www.LeatherGiftItems.com site. We will pay out 3% on every net sale (excludes, checkout discounts, coupons, gift certificates, shipping and tax) for every click through that results in a checkout on our site. No minimum payout required. We will pay out in the form of a business check. Our commission agreement is subject to returns and chargebacks. We do not pay commission on items that are returned or chargebacks. Since we offer a 30-day return policy on our products, please understand that we will pay out on or about every 38 days, to clear out any returns that may result from an Affiliate click through sale.

11. You acknowledge that Gift Items Etc. will send emails from time to time in order to provide updates to the latest tools available to you, as our affiliate. Therefore we require a working email address, phone number and physical address on our Affiliates.

12. You agree that Gift Items Etc./LeatherGiftItems.com cannot be held liable for any omissions, errors, or other difficulties associated with the Affiliate Software, although we will make every attempt to provide a resolution for any technical difficulties that may arise. It obviously behooves us to provide a working Affiliate panel which provides reports on Affiliate earnings and other helpful tools.

13. By filling out the signup form you will automatically become a Gift Items Etc./LeatherGiftItems.com Affiliate and are bound by the terms of this agreement.

14. We retain the right to discontinue Affiliation at our discretion. In such case you will be informed by email and U.S. First Class Mail. Cases such as this would most likely only happen, if Affiliate breaks our policies, after warnings. If the case of this unfortunate outcome, we will continue to payout on previous click-through sales according to the terms of our agreement.

15. Adherence to these terms can, at the very least, provide excellent earnings!
